At rehearsal, they said to me, ‘Yo, you gotta meet up with Atlantic execs.’ I’m like, ‘Yo I’m fucking tired like I don’t wanna talk about no Grammys, I don’t wanna talk about no album, I’m just tired.’ And then I still got drove to a restaurant. Every Dollar Earned by Music Biz Generates Another 50 Cents for US Economy: Study

The study will be firepower for rights holders and trade groups seeking assistance from Congress. It “charts a course for state and federal policymakers to leverage music’s ability to produce strong economic growth and high-paying domestic jobs,” said Josh Friedlander, senior vp research and economics at the RIAA. After the Music Modernization Act’s passage in 2018, no additional copyright legislation should be expected any time soon, but the RIAA always presses issues, such as the lack of a performance right at broadcast radio, and conducts regular Congressional outreach through Grammys on the Hill events. Despite the eye-grabbing numbers that reveal music’s wide-reaching impact, the pandemic’s damage to entertainment industries looms over the report. That was inevitable given the lag tim...

Spinrilla Suffers Legal Blow In Unauthorized Uploads Fight

Source: boonchai wedmakawand / Getty Spinrilla was one of the hottest music apps on the scene when it first launched but now it appears that a shift in business could come soon if recent legal maneuvers spark changes. A lawsuit brought by the RIAA on the behalf of a collective of record companies has culminated in a federal judge striking down Spinrilla’s defense that users are uploading music to the service thus making it exempt from DCMA takedowns. Digital Music News shared in a detailed report on Tuesday (Dec. 1) that the Recording Industry Association of America (RIAA) launched a suit against Spinrilla on behalf of Universal Music Group, Sony Music Entertainment, and Warner Music Group. The suit charges Spinrilla with infringing on the rights of its collection of artists and connected ...

Hip-Hop Streaming Platform Spinrilla Found Liable for Users’ Copyright Infringement

On Monday, U.S. District Judge Amy Totenberg granted summary judgment in favor of the RIAA on the issue of liability and rejected Spinrilla’s DMCA Safe Harbor defense. Totenberg notes that the 11th Circuit hasn’t yet considered whether direct copyright infringement must be willful, but finds “even if volitional conduct is required to prove direct infringement, the cases on which Plaintiffs rely have all held that the affirmative act of streaming constitutes direct infringement of the copyright holder’s exclusive right of performance regardless of the fact that the streaming occurs at the request of the user.” She continues, “Defendants have created an interactive internet player that streams copyrighted content directly from its website and mobile app. In doin...

U.S. Recorded Music Business Still Growing (A Bit) Amid Pandemic: RIAA 2020 Mid-Year Report

The good news: The U.S. recorded-music business was still in an upswing in the first half of 2020, growing 5.6% at retail to $5.7 billion, up from $5.4 billion, continuing a trend of growth that extends back to the industry’s nadir in 2015. The less-good news: That growth, like most everything else in the music business and beyond so far this year, took a pandemic-related hit, ending a short streak of double-digit gains after a 17% boost at mid-year 2017, 10% at mid-year 2018 and 18% at mid-year 2019. Of course, percentage-based growth, by its nature, is always increasingly-difficult to improve upon, and once-in-a-generation pandemics were never going to help keep that streak alive. And within that context there’s still plenty of good news for the industry in its continued recovery amid th...

Via an infographic, the Recording Industry Association of America laid out the songs and albums that moved the needle from the top of the year to the midpoint we’re under now. Other notable Hip-Hop top sellers include Lil Baby’s My Turn, now certified platinum, Lil Uzi Vert’s Eternal Atake, also certified platinum, with Future’...

Twitch Users Are Getting Takedown Notices En Masse for the First Time: Here’s Why

A flurry of copyright takedown notices hit Twitch users last week, causing a storm on social media. Here’s what’s really going on and what to watch for next. Over the last week, users on gaming-focused livestream platform Twitch received a sudden flurry of takedown notices for clips of old videos using unlicensed background music. The more than 2,500 notices — which the RIAA filed on behalf of rights holders for recordings including Ariana Grande’s “7 Rings” and DNCE’s “Cake By The Ocean” — caused a storm on social media, with users complaining on Twitter they felt blindsided by the requests, some for clips dating as far back as 2017. Contrary to some users’ claims, Twitch’s Music Guidelines — which explicitly prohibit users from incorporating music into their streams wit...
