Cross River North: Senator Odey floors Joe Agi at election tribunal
The Election Petitions Tribunal sitting in Calabar Friday, upheld the victory of the Peoples Democratic Party (PDP) candidate, Dr. Stephen Odey, in the Cross River North Senatorial District by-election. Delivering the judgment in a petition by Joe Agi (SAN) with number: EPT/CR/SEN/03/2020, the chairman of the three-man election tribunal, Justice Yusuf Muhammad, upheld the preliminary objection raised by Odey’s lawyer that the two grounds of petition were pre-election matters. The Tribunal, therefore, struck out the petition for lack of merit. The tribunal also held that Jarigbe Agom, who is the second respondent in the petition, was never cleared nor contested the December 5, 2020, PDP primaries. Zambia’s Constitutional Court ruled on Friday that President Edgar Lungu can stand for re-election in August, throwing out a second opposition challenge to his eligibility on the basis of the constitutional two-term limit. The ruling comes as Zambia faces a multipronged economic crisis, after overleveraging its debt right before the brutal global COVID-19 shutdown. Appeal Court strikes out Facebook’s appeal against trademark judgment
The Court of Appeal sitting in Lagos, Tuesday, dismissed Facebook’s appeal challenging the judgment of a Federal High Court, Lagos, which awarded N10 million against it (Facebook) in favour of a Nigerian firm, Double Paws Enterprise, as damages for unlawfully interfering with the use of the firm’s trademark. The appellate court justices that decided the matter were Justices Haruna Tsammani, Oluwayemisi Williams-Dawodu, and Abdullahi Bayero. Justice Bayero read the lead judgment. Fire guts goods worth over N35 million in Aba
A late evening fire outbreak on Thursday gutted a three-storey building at No 74 Jubille Road, Aba, Abia, destroying goods worth more than N35 million. The fire also gutted a makeshift warehouse at the back of the three-storey building with Motorcycle spare parts and also burnt the contents of rooms on three floors at the back of the main building. Newsmen visited the scene of the incident and reports that the three-storey building, other adjoining blocks with their wares were not spared by the inferno. Court orders final forfeiture of ex-Zamfara governor’s money in Zenith, Polaris banks
The Federal High Court, Abuja, on Tuesday, ordered the final forfeiture of former Governor of Zamfara, Abdulaziz Yari’s funds domiciled in Zenith and Polaris Banks. While 56, 056.75 dollars was lodged in Polaris Bank account, the sums of N12.9 million, N11.2 million, 301, 319.99 dollars; N217, 388.04 and 311, 872.15 dollars were kept in different Zenith Bank accounts in the name of Yari and his companies. Justice Ijeoma Ojukwu, in a judgment, held that the former governor had not shown good cause why the order sought by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) should not be granted. Jegede is challenging the outcome of the election in which Governor Rotimi Akeredolu was declared the winner by the Independent National Electoral Commission. One of the grounds in the Jegede’s petition was that Akeredolu was not eligible to contest the election. The PDP and Jegede had initially listed 400 witnesses and other exhibits before the tribunal while they had requested for additional nine days to defend their case before the court. The chairman of the Caretaker Committee of the Edo State chapter of the All Progressives Congress (APC), Col David Imuse (rtd), has said that the party would appeal Saturday’s judgement by the Federal High Court, Abuja, which dismissed the alleged certificate forgery suit filed against Governor Godwin Obaseki by the party. CBN: Naira to fall further in January
Barely five days to the end of the year 2020, the Central Bank of Nigeria has disclosed that a survey carried out by its Statistics Department revealed that the naira is expected to depreciate further in January 2021. The report, titled, ‘December 2020 Business Expectations Survey Report’ added that there might also be a steady rise in interest rate from December till the next six months. The naira witnessed a sharp fall in recent weeks, reaching its lowest on November 30, 2020, when it exchanged for N500/$1. Since then, the dollar has been hovering between N460 and N470. As of Friday, however, one dollar exchanged for 465 in the parallel market. Police ordered to arraign suspect detained for one year
The Independent Investigative Panel probing police brutality in Abuja, on Thursday, gave the police a six-day ultimatum to arraign a suspect, Raphael Toona, who has been in detention for about one year. The Chairman of the panel, Justice Suleiman Galadima (retd.), ordered that Toona should be arraigned on or before December 23. Justice Galadima gave the order following an application by Toona’s lawyer, N. T. Utasha, urging the panel to order the police to either release the suspect or arraign him in court. “The first complaint (Toona) should be taken to Benue State to be arraigned before a court of competent jurisdiction on or before December 23, 2020 where his bail should be considered, considering the fact that he has been in detention for more than a year,” Justice Galadima ordered. Lekki shootings: Nigerian Army legal team submits report to General Buratai
The legal team set up by the Nigerian Army to represent the service at the ongoing Lagos State Judicial Panel of Inquiry on the alleged shooting of protesters at the Lekki Tollgate has submitted its report to the Chief of Army Staff (COAS), Lt-Gen. Tukur Buratai. The team, led by Akinlolu Kehinde, said the Nigerian Army was not under any form of trial over the alleged shooting at the Lekki Tollgate. The team has as members, the Director Legal Services of the Nigerian Army, Brigadier General M.U. Wambai, Samuel Agweh, Biola Oyebanji and Colonel Michael Ede.
