Senator Abiru flours PDP, Babatunde Gbadamosi at Supreme Court
The Supreme Court has dismissed the People’s Democratic Party, PDP’s appeal, seeking to disqualify Senator Adetokunbo Abiru of the All Progressives Congress (APC) from continuing to represent the Lagos East Senatorial District. It upheld the argument of Kemi Pinheiro, (SAN) for Abiru and Abiodun Owonikoko (SAN) for APC that the appeal lacked merit. The court also awarded a cost of N1 million against the appellants – PDP and its candidate, Babatunde Gbadamosi, in favour of each of the respondents, Abiru and the APC. The Election Petitions Tribunal sitting in Calabar Friday, upheld the victory of the Peoples Democratic Party (PDP) candidate, Dr. Stephen Odey, in the Cross River North Senatorial District by-election. Delivering the judgment in a petition by Joe Agi (SAN) with number: EPT/CR/SEN/03/2020, the chairman of the three-man election tribunal, Justice Yusuf Muhammad, upheld the preliminary objection raised by Odey’s lawyer that the two grounds of petition were pre-election matters. The Tribunal, therefore, struck out the petition for lack of merit.
