A lawsuit against Childish Gambino alleging that he plagiarized another song to make his Grammy Award-winning track "This Is America" has been dismissed in court. In the ruling, the judge deemed the allegations by rapper Kidd Wes weren't substantial, saying elements of the songs were "entirely different and not substantially similar." Record Store Day 2022’s fingerprints are all over Billboard’s Top Album Sales chart (dated May 7), as six of the top 10 have sales owed to a special release for the annual indie retailer holiday. Leading the pack at No. 1 is Childish Gambino’s Kauai EP, which debuts atop the list with 17,000 sold in the U.S. in the week ending April 28, according to Luminate. It’s his first No. 1 on the chart, and third top 10. As spotted on Hype Beast the California native has just been hit with a lawsuit surrounding his classic single “This Is America”. Earlier this week Wes, real name Emelike Wesley Nwosuocha, filed paperwork saying the Atlanta star borrowed several parts from his song “Made in America.” The track was originally uploaded to the Soundcloud streaming service in 2016 as part of Wes’ initial push for the track.
